Terms & Conditions – Option 1: whole home

The New Home Program (the “Program”), from FortisBC Energy Inc. and FortisBC Inc. (together, “FortisBC”), provides FortisBC customers (each, an “Applicant”) who complete the building of a qualifying ENERGY STAR® New Home and install qualifying high-efficiency appliances and products between April 1, 2015 and March 31, 2018 (the “Term”) with an incentive payment(s) (an “Incentive”) pursuant to these terms and conditions. These Option 1 Terms and Conditions are applicable when an Applicant builds a qualifying ENERGY STAR New Home.

Development eligibility

An ENERGY STAR New Home (“ESNH”) is defined as a home that has been built by a registered ESNH builder who incorporates energy-efficient features into the home meeting the specifications in Natural Resources Canada’s (“NRCan's”) ESNH Standard Version 12.6, as amended and updated from time to time (the “ESNH Standard Version”). An ESNH is evaluated on-site by an energy advisor (an “Energy Advisor”), who has been recruited, trained and certified by an NRCan licensed ESNH Service Organization (a “Service Organization”).

  1. To qualify for funding from the Program, the residence:
    1. must be an ESNH and new construction;
    2. must be constructed in FortisBC’s natural gas, propane, and/or electric service territories, including the service territories of Nelson, Penticton, Summerland and Grand Forks; 
    3. must NOT be constructed in an area which already requires the Applicant to comply with municipal bylaws or building codes which equal or exceed the specifications in the ESNH Standard Version 12.6; and  
    4. must be located at the address stated in the “Development Information” portion of the application form (the “Development”).
  2. The Applicant must be the beneficial owner of the Development at the time of construction and must have incurred the costs associated with building the ESNH in order to be eligible for payment of an Incentive(s) under the Program. For greater certainty, the Applicant is typically the builder, developer or single homeowner that has retained a contractor for the Development. Individuals purchasing a new ESNH in a Development from a developer/builder do not qualify. 
  3. The Program applies only to new residential buildings that:
    1. are not more than four (4) storeys in building height;
    2. are not more than 600 m2 in building area;
    3. are on permanent foundations; 
    4. are one of the following types:
      1. detached houses, including houses with secondary suites; or
      2. attached houses, which include semi-detached houses (duplex or triplex), townhouses, row houses, and attached houses with secondary suites;
      3. laneway homes which achieve a minimum EnerGuide rating of 82.
  4. ESNH does not apply to non-residential units in a Development.

High-efficiency appliance and product requirements

  1. All appliances and products installed in the ESNH must meet the applicable qualifications set out by FortisBC at the Program website at: fortisbc.com/newhome
  2. Dryers: dryers must be ENERGY STAR certified and listed on the ENERGY STAR directory. Incentives for electric model dryers are only available to electric customers of FortisBC, and municipal customers of Nelson, Penticton, Summerland, and Grand Forks. 
  3. Natural gas appliances: natural gas appliances must be listed on fortisbc.com/newhome to be eligible for Incentive(s). Natural gas appliances must be installed in accordance with the requirements of Technical Safety BC and/or gas authority having jurisdiction in the Applicant’s area and in accordance with the manufacturer’s specifications and all applicable laws, codes, standards and ordinances.

Incentive amounts

  1. Incentive amounts available for the Program are listed at fortisbc.com/newhome.
  2. Incentive amounts may be changed at FortisBC’s sole discretion, and will be paid in accordance with the incentive amounts available on the completion date of a project.
  3. Notwithstanding anything in these terms and conditions, payment of Incentive(s) is subject to the availability of funds and may change at any time without notice.

Application process for incentive(s)

  1. Applicants must complete and submit the Program application form.
  2. An application to the Program must be submitted within six months of issuance of a building occupancy permit for the Development.
  3. For purposes of confirming that the homes meet the requirements of the ESNH Standard Version, the Applicant or the Energy Advisor will supply FortisBC with the following:
    1. ESNH Single Family Homes and Townhouses/Row houses and Duplexes:
      1. a copy of NRCan’s ESNH verification checklist, which must include the manufacturer and model number for ENERGY STAR electric and natural gas appliances as proof of installation;
      2. pre-construction energy upgrade report as applicable;
      3. mid-construction consultation report or equivalent; 
      4. a copy of the EnerGuide file number and approved EnerGuide rating for each EnerGuide rated housing unit (when applicable); and
      5. copy of the NRCan compliance report as formal evidence which confirms that the building meets the ESNH requirements.
    2. For EnerGuide 82 laneway homes:
      1. an EnerGuide report indicating a rating of EnerGuide 82 or higher; and
      2. copies of clear, legible, sales receipt(s) and/or invoice summaries to clearly indicate the manufacturer, model number or other relevant information, proof of payment for the fireplaces and ENERGY STAR dryers or digital photos of appliance make and model numbers.  
    3. For natural gas stand-alone incentives (including dryers and fireplaces): 
      1. for the purposes of confirming that the products are eligible for Incentives, the Applicant must supply a copy of the purchase invoice(s) that contains the purchase date and make and model number(s) or digital photos of appliance make and model numbers.  
  4. Applications and supporting documents must be postmarked no later than midnight, September 30, 2018. 
  5. Processing of applications may take up to 90 days upon receiving all required documents, unless the Applicant’s application is selected for verification which may result in additional processing time. FortisBC is not responsible for lost, delayed, damaged, illegible or incomplete applications. Incentives will be issued in the form of a cheque to the Applicant.

General terms and conditions

  1. FortisBC has the right to inspect the Development to verify the installed product(s) before an Incentive is paid, and the Applicant will allow, if requested, a FortisBC representative reasonable access to the Development for such verification. Applicants agree that no Incentive will be paid if the inspection is refused. 
  2. FortisBC’s decisions relating to the Program, including without limitation product acceptability, customer eligibility and amount of the Incentive, shall be final and binding and not subject to appeal. 
  3. FortisBC reserves the right to change or terminate the Program at any time without notice. A completed eligible application received prior to a change or termination of the Program will be administered in accordance with the Program as it existed effective as of the date of the application. 
  4. The products approved for Incentives cannot be combined with any other FortisBC offer or promotion.
  5. The Applicant agrees that the selection, purchase, installation and ownership/maintenance of the appliances, products or equipment for which the Applicant is claiming a rebate are the Applicant’s sole responsibility and that the provider(s) of same is/are not affiliated with FortisBC and that FortisBC is not liable for any act or omission of such provider. The Applicant understands that FortisBC makes no representation or warranty, whether express or implied, in respect of any such appliances, products or equipment that the Applicant has chosen or for which an Applicant has applied for an Incentive under the Program. The Applicant agrees FortisBC has no liability concerning: (a) the quality, safety, and/or installation of the products; (b) the estimated energy savings of the products; (c) the workmanship of any third parties; and (d) the installation or use of the products.
  6. The Applicant acknowledges and agrees that the Applicant is liable for any tax imposed upon or payable by the Applicant in respect of any Incentive. 
  7. The Applicant agrees that FortisBC is not responsible in any circumstances whatsoever for any actions, omissions, recommendations or advice of any Service Organization or Energy Advisor engaged by the Applicant in connection with the Program.
  8. The Applicant hereby agrees to indemnify and save harmless FortisBC Energy Inc. and FortisBC Inc. and their respective directors, officers, agents and employees from all liability, damages, claims, demands, expenses and costs for claims, costs for injury or death of any person, damage to or destruction of property and all economic loss suffered by any person arising from or occurring by reason of the Program, including receipt of Incentives, or actual or alleged use of the ESNH and/or products installed for which an Incentive is provided under the Program, including any actions or omissions by third party consultants or contractors in the preparation or installation of the products or ESNH.
  9. The Applicant is responsible for meeting all Program requirements, and complying with any laws, regulations or by-laws regarding permits, codes, restrictions or inspections in relation to appliances, products or equipment installed. FortisBC is not responsible for any late, lost, incomplete, illegible, misdirected, delayed or destroyed application forms, and will not accept application forms related to previous iterations of this or similar programs. 
  10. The terms and conditions outlined in this document will be governed by and interpreted in accordance with the laws of the Province of British Columbia.

Personal information and protection of privacy

  1. FortisBC collects, uses and discloses personal information in accordance with provisions of the Personal Information Protection Act (“PIPA”) and its Privacy Policy (which is located at fortisbc.com/privacy).
  2. For the purposes of this Program, and these terms and conditions, “Applicant Information” means all information disclosed by the Applicant in any Program application materials. By applying for this Program, the Applicant acknowledges and agrees that:
    1. FortisBC collects and uses the Applicant Information for the purposes of processing, administering, and evaluating the Program and developing other FortisBC energy-efficiency programs;
    2. Participant Information may be disclosed to NRCan for the purposes of processing, administering, and evaluating the Program and developing other energy-efficiency programs.  The Applicant hereby authorizes FortisBC to collect this information indirectly through NRCan and/or the Energy Advisor and Service Organization they represent;
    3. FortisBC may contact the Applicant in the future to review the effectiveness of the Program, which may include surveys; and 
    4. Participant Information may be disclosed amongst FortisBC Energy Inc., FortisBC Inc., and evaluation service contractors for the purposes of administering and evaluating this Program as described herein and developing other FortisBC energy-efficiency programs.
