Business Direct Install Program terms and conditions

The Business Direct Install Program (the “Program”) from FortisBC Energy Inc. and FortisBC Inc. (collectively “FortisBC”) provides eligible commercial customers (each, a “Participant”) with an opportunity to improve the performance of their business through more efficient use of electricity and/or natural gas. Participants in the Program may be entitled to receive:

  1. access, through the Participant’s contractor, to an energy assessment tool and a customized energy savings report (the “Energy Savings Report”) to help the Participant identify and implement measures for improving energy efficiency;
  2. point-of-sale rebates (“Point-of-Sale Rebates”) for the installation of select energy conservation measures ( “ECMs”, and each an “ECM”); and
  3. assistance in applying for other FortisBC rebates or programs, as necessary (“Rebate Support”).

(together, the Energy Savings Report, Point-of-Sale Rebates, and Rebate Support are referred to as the “Program Offerings”).

Program eligibility requirements

  1. In order to be eligible to participate in the Program, each Participant must meet the following eligibility requirements:
    1. the Participant must be an electric customer of FortisBC, or a municipal customer of Grand Forks, Summerland, Penticton or Nelson, in good standing, who is not in arrears at the time of participation in the Program;
    2. The facility that is the subject of participation in the Program must: 
      1. receive electric service under a Small Commercial Service rate class or Commercial Services rate class or, for municipal customers, a general service rate class;
      2. consume, on average, equal to or greater than 12,000 kWh/year of electricity; 
      3. have a monthly billing demand equal to or below 200 kVA; and
      4. be owned by the Participant or leased by the Participant under a Long-term Lease. “Long-term Lease” means a lease with a term of 120 months or more, with an option to renew for at least a further 60 months, which lease will continue for at least 36 months prior to expiry at the time of participation in the Program. Upon request, the Participant shall provide, in a form satisfactory to FortisBC, in its sole discretion, proof of ownership or details and landlord confirmation of a Long-term Lease. Proof of ownership may include a recent title search.
  2. In order to be eligible for rebates for ECMs to reduce natural gas consumption, Participants must:
    1. be a natural gas customer of FortisBC in good standing, who is not in arrears at the time of participation in the Program; and  
    2. use natural gas to generate hot water for domestic consumption.

Program offer

  1. Each approved Participant will receive:
    1. Access, via a contractor engaged by the Participant, to an energy assessment tool;
    2. A customized Energy Savings Report, which:
      1. identifies opportunities to reduce energy consumption in the Participant’s facility by installing certain ECMs, and FortisBC Point-of-Sale Rebates available for the installation of such ECMs; and
      2. contains a proposal by the Participant’s contractor to complete the installation of the above-noted ECMs;
    3. Point-of-Sale Rebates for the installation of identified electric and natural gas ECMs:
      1. Point-of-sale rebates offered for electric ECMs are capped to the lesser of:
        1. $0.15 per annual kWh of electricity saved by the installation of the ECM, as determined by the energy assessment;
        2. 50 per cent of installed ECM cost; and
        3. the amount sufficient for the Participant to achieve a two-year payback following the completion of installation of the ECM
      2. Point-of-Sale Rebates are offered for the following natural gas ECMs:
        1. kitchen aerators: $10/unit;
        2. bathroom aerators: $10/unit; and
        3. pre-rinse spray valves: $111/unit;
      3. The maximum total value of Point-of-Sale Rebates available to each Participant under the Program is $10,000. Where the total value of Point-of-Sale Rebates is estimated to exceed $10,000, the Participant will be forwarded to the Custom Business Efficiency Program or other FortisBC incentive programs; and
    4. Rebate support:
      1. Participants interested in applying for other FortisBC rebates or programs may receive assistance in applying for such programs or rebates.

Program process

  1. Participants who contact FortisBC regarding participation in the Program will be directed to a list of contractors in their geographical area who have access to the energy assessment tool.
  2. The Participant and the Participant’s contractor will arrange for an energy assessment to be performed at the Participant’s facility at a date and time suitable to both.
  3. The Participant’s contractor will provide the Participant with an Energy Savings Report. The Energy Savings Report will:
    1. identify opportunities to reduce energy consumption in Participant’s facility by installing certain ECMs;
    2. identify FortisBC Point-of-Sale Rebates available for the installation of such ECMs;
    3. contain these Terms and Conditions for acceptance by the Participant; and
    4. contain a proposal by the Participant’s contractor to complete the installation of the above-noted ECMs (the “Proposal”). The Proposal will include the total cost to install the ECMs, including FortisBC Point-of-Sale Rebates. 
  4. If the Participant accepts the Proposal and these Terms and Conditions, the Participant will complete the requisite application materials contained in the Energy Savings Report and will enter into any additional contracts that may be required as between the Participant and the Participant’s contractor.
  5. The Participant and the Participant’s contractor will arrange a mutually acceptable time to complete the installation of the ECMs. 
  6. At the direction of the Participant, the Participant’s contractor will forward to FortisBC and the Program Contractor (as hereinafter defined) information about the Participant’s eligibility for other FortisBC rebates or programs. FortisBC or the Program Contractor will then contact the Participant to provide assistance in applying for such programs or rebates.
  7. FortisBC and/or its authorized agents may schedule an additional visit to the Participant’s facility to conduct performance/evaluation testing in support of overall Program administration and evaluation.

Participant responsibilities, representations and warranties

  1. By accepting these Terms and Conditions, the Participant represents, warrants and agrees as follows:
    1. the installation of ECMs must be completed by a contractor listed on the Program’s participating contractor list. Inclusion of a contractor in the Program’s participating contractor list does not constitute an endorsement of any individual or company by FortisBC.
    2. the selection of a contractor to perform the energy assessment and the installation of the ECMs is the sole decision of the Participant. 
    3. the Program will be administered and the Program Offerings delivered by FortisBC and an authorized FortisBC agent (the “Program Contractor”);
    4. the Participant will allow the Participant’s contractor, FortisBC and the Program Contractor full access to the Participant’s facility that is the subject of participation in the Program and all relevant equipment within. The Participant will take all reasonable measures and actions to ensure such facility is safe for the Participant’s contractor, FortisBC, and the Program Contractor to enter and deliver the Program Offerings;
    5. the Participant will take all reasonable steps to provide relevant information as requested by FortisBC; and
    6. the Participant will allow FortisBC and its authorized agents to conduct any performance/evaluation testing as requested, including but not limited to testing of ECMs, post-consumption testing and surveys.

Additional terms and conditions

  1. The Program will be in effect between January 1, 2016, and December 31, 2017. Products must be purchased no later than December 31, 2017 to be eligible for a rebate and applications for must be received by FortisBC no later than April 30, 2018.
  2. This Program cannot be combined with any other FortisBC offer, unless otherwise specified. 
  3. FortisBC does not endorse any particular manufacturer, product, system, design, supplier, contractor or installer in promoting the Program.
  4. While FortisBC will make reasonable efforts to ensure that the energy assessment tool is accurate, the Participant acknowledges and agrees that the energy assessment does not constitute a detailed engineering analysis and FortisBC makes no representations or warranties, express or implied, that if implemented, the recommendations contained in the Energy Savings Report will satisfy the requirements of the Participant, or any law, specification or contract. The Participant is responsible for conducting more detailed engineering design and analysis prior to implementing any significant energy upgrade projects.
  5. The Participant acknowledges and agrees that any recommendations implemented or incentives or opportunities pursued by the Participant are the sole discretion and responsibility of the Participant and FortisBC is not responsible for any damages arising from same.
  6. FortisBC, not being the designer or manufacturer of the ECMs, makes no representation or warranty, express or implied as to the fitness, design or capability of the material, equipment or workmanship of the ECMs nor the installation of ECMs nor any warranty that the ECMs will satisfy the requirements of the Participant or any law, specification, or contract.
  7. The Participant acknowledges and agrees that any Rebate Support required by the Participant is at the Participant’s sole discretion and FortisBC is not liable for damages arising from same. FortisBC makes no representations or warranties, express or implied, that the Rebate Support provided pursuant to the Program will satisfy the requirements of the Participant, or any law, specification or contract.
  8. The Participant does hereby indemnify and save harmless FortisBC Energy Inc., FortisBC Inc., the Program Contractor, and their respective directors, officers, agents and employees from all liability, damages, claims, demands, expenses and costs for claims, costs for injury or death of any person, damage to or destruction of property, and all economic loss suffered by any person arising from or occurring by reason of the Program, including but not limited to actual or alleged preparation or installation or use of the ECMs, except to the extent caused by the gross negligence or willful misconduct of FortisBC Energy Inc., FortisBC Inc., the Program Contractor or their respective officers, employees, or agents.
  9. FortisBC may amend, modify or terminate this Program and these Terms and Conditions at any time based on funding limitations or for any other reason without notice. FortisBC will accept participants to the Program in its sole discretion.
  10. FortisBC reserves the right to refuse applications which it determines in its sole discretion, are incomplete, inaccurate or otherwise do not meet the requirements of the Program. FortisBC is not responsible for lost, delayed, damaged, illegible or incomplete applications.
  11. For the purposes of this Program, and these Terms and Conditions, “Participant Information” means all information disclosed by the Participant in any Program application materials, as well as any data respecting billing, energy use and consumption at the premises at which the energy assessment is performed for a period of one year prior to participation in the Program and one year after participation in the Program. By applying for this Program, the Participant acknowledges and agrees that:
    1. FortisBC collects and uses the Participant Information for the purposes of processing, administering, and evaluating the Program and developing other FortisBC energy-efficiency programs;
    2. FortisBC may contact the Participant in the future to review the effectiveness of the Program, which may include surveys;
    3. FortisBC may retrieve the Participant’s billing, energy use and consumption information from the FortisBC account database for the period set out above for the purposes of analyzing consumption behavior and energy savings attributable to the Program; and
    4. Participant Information may be disclosed amongst FortisBC Energy Inc., FortisBC Inc., and their authorized agents for the purposes of administering and evaluating this Program as described herein and developing other FortisBC energy-efficiency programs.
  12. The Participant acknowledges and agrees that FortisBC will share the Participant Information with the contractor engaged by the Participant for the sole purpose of administrating the Program and conducting Program activities.
  13. FortisBC may promote the Program and its provision of Program Offerings to the Participant through whatever means FortisBC deems appropriate. FortisBC may request the Participant take part in media activities, such as photo opportunities, which the Participant must not unreasonably withhold or delay and the Participant will make best efforts to ensure that any necessary consents or releases are executed with respect to photography.
