FortisBC - Direct Community Engagement Contest - Official Contest Rules
1. OVERVIEW AND ELIGIBILITY

Direct Community Engagement Contest (the “Contest”) is being offered by FortisBC Energy Inc. and FortisBC Inc. (“FortisBC”).

a) The Contest is open to residents of British Columbia who have reached the age of nineteen (19) years.

b) Contestants do not to need to be a FortisBC customer to participate.

c) Employees and contractors of FortisBC Energy Inc. and FortisBC Inc. and their parent, subsidiary and affiliate companies are not eligible to enter.

d) By entering the Contest, the contestant affirms that he/she is at least nineteen (19) years of age.

e) By entering, each contestant agrees to and accepts these Contest rules.

f) The following information will be collected on the ballots:

    • Name
    • Address
    • Email
    • City
    • Phone Number

g) Skill testing question must be correctly answered before an entrant is declared a winner.

2. HOW TO ENTER

No purchase necessary. The Contest has two parts.

Part One - Individual Community Engagement Contest:

To enter, eligible entrants must enter by fully completing either a paper ballot or digital entry ballot, which will be available at a FortisBC booth at selected community events in the four communities (“Participating Communities”) listed below or by email request as explained below.

Entrants who enter the Contest at an event in one of the four Participating Communities listed below will be entered in the draw for that community for a chance to win the Individual Community Engagement Contest prize for that community.

To receive a digital entry ballot without attending an event in a Participating Community, eligible entrants who would still like to make a promise to save energy and enter the Contest may send an email, with the subject line “Direct Community Engagement Contest ballot request”, to conservation@fortisbc.com, to be received by 11:59 p.m. on October 23, 2018 and they will then be sent a digital Contest ballot. Digital ballots will be designated for one of the draws referred to below as selected by FortisBC in its discretion. Digital ballots must be completed in full and submitted by October 30, 2018.

LIMIT one entry per person throughout the Contest, regardless of method of entry.

Entry dates and corresponding draw dates are as follows:

On their paper or digital entry ballot, entrants will be required to make a promise to do one of the following, depending on the community in/for which they are entering:

Saanich and Summerland

  • Insulating light switches and outlets on exterior wall with foam gaskets;
  • Draftproofing my home’s exterior doors and windows with caulk or weatherstripping;
  • Asking a qualified Energy Advisor how to improve my homes draftproofing.

Vancouver and Surrey

  • Draftproofing my home with outlet gaskets, caulk or weatherstripping
  • Having a licensed gas contractor service my heating system for safety and energy efficiency
  • Keeping my shower time to five minutes

Part Two: Community Engagement Grand Prize Contest: All entrants of the Contest in Part One will receive an email message from FortisBC (the “Second Promise Email”) and will be asked to make a second promise to do one of the following:

  • Program thermostat to no more than 17°C when out and asleep and 20°C or less when home and awake.
  • Draftproof my home’s exterior doors and windows with caulk or weatherstripping.
  • Wash laundry in cold water.

To be entered in the Grand Prize draw, Entrants must fully complete and submit the digital entry ballot attached to the Second Promise Email. Entrants who have been declared winners of a prize in Part One of the Contest are still eligible for the Grand Prize.

Limit of one entry per person. Only persons who receive the Second Promise Email are eligible to enter Community Engagement Grand Prize Contest.

3. PRIZING

a) Individual Community Engagement Contest Prize

There is 1 (one) prize available to be won for each community, for a total of four (4) Individual Community Engagement Contest Prizes, each consisting of:

  • (1) one $500 CAD Visa gift card to the winner. Gift card is subject to the terms and conditions of the issuer. Visa is not a participant in or sponsor of this promotion.
  • (1) one $500 CAD donation to a non-profit registered charity as selected by Contest winner and approved by FortisBC. The non-profit registered charity must be in the community in which the entries were gathered (or such other community as may be approved by FortisBC in its discretion).

b) Community Engagement Contest Grand Prize

There is 1 (one) Grand prize available to be won and it consists of:

  • (1) one $1500 CAD Visa gift card for the winner. Gift card is subject to the terms and conditions of the issuer. Visa is not a participant in or sponsor of this promotion.
  • (1) one $1500 CAD donation to a non-profit registered charity, as selected by Contest winner and approved by FortisBC.

c) Charitable donation aspect of prizes will be made by FortisBC in the name of the respective winner. FortisBC reserves the right to veto a designated charity in its discretion and require winner to designate an additional charity or charities, should a designated charity be, in FortisBC’s determination, inappropriate or inconsistent with the spirit of the Contest or FortisBC’s objectives or values.

d) No substitution. The prize must be accepted as awarded. No cash alternatives substitution or transfer of the prize will be allowed.

e) FortisBC may substitute a prize of equal or greater value based on the approximate retail value of the prize as described in these official Contest rules, including without limitation, a cash award, if a prize or prize component cannot be awarded for any reason. The prize winner is solely responsible for all costs not expressly described herein.

4. WINNER SELECTION

a) Random draws will be conducted by FortisBC on the dates and times specified in the tables above, to select a total of four (4) entries for Individual Community Engagement Contest Prizes and one (1) entry for the Community Engagement Grand Prize.

b. Odds of winning:

  • an Individual Community Engagement Contest Prize depends on the number of eligible entries received for each draw.
  • the Community Engagement Grand Prize depend upon the number of eligible entries received from those entrants who received the Second Promise Email from FortisBC and complete and submit the digital entry ballot attached thereto in accordance with these rules.

5. NOTIFICATION

a) Potential winners will be contacted after each draw date via the email address and/or phone number they supplied when entering the Contest. FortisBC will attempt to reach the potential winners no more than three (3) times. If FortisBC is unable to contact the selected contestant within five (5) days of the first attempted contact, FortisBC may select another potential winner to claim the prize. Each potential winner must correctly answer the skill testing question contained on the ballot in order to receive the prize.

b) Before being declared a winner, each selected entrant must sign and return FortisBC’s Declaration and Release Form confirming eligibility for and compliance with these official Contest rules, accepting the prize as awarded and confirming the releases set out in Rule 5.c. and 6.a. below. The selected contestant will have seven (7) days from the date of receipt to return a signed copy of the Declaration and Release Form to FortisBC. If the selected contestant does not do so within this period of time or is otherwise unwilling or unable to accept the prize and comply in full with these rules, FortisBC may at its sole discretion randomly select another contestant or cancel the Contest, and the initial selected contestant will be disqualified and will have no recourse towards FortisBC or anyone involved in the Contest

c) By entering the Contest, the contestant agrees that if selected as a confirmed winner, such winner will allow FortisBC to publish his/her name and photo on FortisBC’s website or publications produced by FortisBC and will sign a photo release acknowledging same. Failure to comply with this requirement may result in forfeiture of a prize.

d) Prize claim is subject to verification by FortisBC and/or its designated representatives. Entries made with multiple addresses, or under multiple identities, may be void at the sole discretion of FortisBC. All Contest entries obtained through unauthorized sources or that are incomplete, illegible, mutilated, altered, reproduced, forged, irregular, or fraudulent in any way or otherwise not in compliance with these Rules may be void at the sole discretion of FortisBC. FortisBC will be the sole and final reference source in validating a prize claim.

6. INEDEMNIFICATION/RELEASE OF LIABILITY

a) The Contest winners agree, by accepting a prize, and each contestant agrees, by entering or participating in the Contest, to release, discharge, indemnify and hold harmless FortisBC Energy Inc. and FortisBC Inc. and their respective parent companies, subsidiaries, affiliates, distributors, retailers, web development companies, advertising and promotional agencies, municipalities, prize suppliers and any other individuals or legal entities participating in the design, administration or fulfillment of this Contest and their respective officers, directors, employees and agents (collectively “Released Parties”) from and against any and all liability for any threatened or actual injuries, loss, or damage of any kind to person, including death or disability, and property, arising in whole or in part, directly or indirectly, from participation in this Contest or acceptance, possession, use, or misuse of a prize, participation in any Contest-related activity or inability to participate in parts thereof including, without limitation, claims, suits, injuries, losses, and damages related to personal injuries, death, damage to or destruction of property, violation of the rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, and whether or not caused in whole or in part by the negligence of one or more of the Released Parties. Contestants covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit, or rescind this release. A waiver by FortisBC of any term in these Rules does not constitute a waiver of any other provision.

7. GENERAL RULES

a) This Contest shall be governed by and construed in accordance with the laws of the province of British Columbia.

b) FortisBC, in its sole and absolute discretion, reserves the right to modify or terminate this Contest or these terms and conditions at any time, without individual notice, and for any reason.

c) If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, cheating, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt, or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Contest FortisBC reserves the right to cancel, modify, or suspend any or all aspects of the Contest. FortisBC assumes no responsibility for lost, delayed, incomplete, garbled, undelivered, damaged or misdirected entries or for any technical problems of any kind affecting the operation or administration of this Contest, including, without limitation, any technical malfunction or failure of, or any other problem with, any computer hardware or software or any telephone network or lines or broadcast transmission.) If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, cheating, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt, or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Contest FortisBC reserves the right to cancel, modify, or suspend any or all aspects of the Contest.
